Does my business music service cover SAMPRA rights?

Do not assume it does. SAMPRA states that personal streaming subscriptions do not cover a business's licensing obligation. A commercial provider may have a licensed catalogue, but you must verify whether it covers public performance in South Africa for your premises and use.

Check the catalogue, playback method, copying, live use, radio or television, branches and whether the provider pays SAMPRA on your behalf. You must also consider SAMRO rights in the musical work.

Our terms answer the MelloJam case directly. We own the compositions, recordings, performances and catalogue, our catalogue contains no third-party music, and your plan includes the commercial playback rights we control through the MelloJam player. If your business plays only MelloJam through the player, you do not need a separate SAMPRA licence for the MelloJam catalogue. The only exception in our terms is a non-waivable government, statutory or collecting-society charge that local law imposes directly on the venue.
