Does my business music service cover RE:SOUND rights?

It may. RE:SOUND says that a background music supplier may pay the required fee on behalf of the establishment, depending on the subscription agreement. It also says this is not always the case.

Check whether the service covers public performance in Canada, your premises, the supplied catalogue, RE:SOUND and SOCAN rights, copying, live music and any music from another source. Keep proof of what the provider pays.

Our terms answer the MelloJam case directly. We own the compositions, recordings, performances and catalogue, our catalogue contains no third-party music, and your plan includes the commercial playback rights we control through the MelloJam player. If your business plays only MelloJam through the player, you do not need a separate RE:SOUND or Entandem licence for the MelloJam catalogue. The only exception in our terms is a non-waivable government, statutory or collecting-society charge that local law imposes directly on the venue.
