Does a business music service cover PPCA rights?

It may cover some or all PPCA rights for the catalogue it supplies, but do not infer this from the word business or licensed. Check whether the service permits public playback in Australia, covers your premises and includes the recordings you use.

Also check the separate musical work rights and whether your business must hold a OneMusic Australia licence. A provider's agreement to supply recordings is not automatically the same as your business's public performance permission.

Our terms answer the MelloJam case directly. We own the compositions, recordings, performances and catalogue, our catalogue contains no third-party music, and your plan includes the commercial playback rights we control through the MelloJam player. If your business plays only MelloJam through the player, you do not need a separate PPCA licence for the MelloJam catalogue. The only exception in our terms is a non-waivable government, statutory or collecting-society charge that local law imposes directly on the venue. The OneMusic Australia licence route remains relevant to other music sources.
