Does my business music service cover ASCAP rights?

It may cover the music it supplies, but do not assume that the provider's licence covers your entire business. ASCAP's own guidance says provider licences can have limits based on the music supplied and the type of establishment.

Check the provider's country, catalogue, premises, playback method, admission or membership conditions, and whether live music, radio, television or other sources are excluded. Also check sound recording rights and other US PRO catalogues.

Our terms answer the MelloJam case directly. We own the compositions, recordings, performances and catalogue, our catalogue contains no third-party music, and your plan includes the commercial playback rights we control through the MelloJam player. If your business plays only MelloJam through the player, you do not need a separate ASCAP licence for the MelloJam catalogue. The only exception in our terms is a non-waivable government, statutory or collecting-society charge that local law imposes directly on the venue. The ASCAP licensing portal remains relevant to other music sources.
